Dubai Dream Rentals Obligations
Keys
Dubai Dream Rentals (DDR) shall ensure that the Tenants have full stets of keys to the property at the commencement of the Holiday Let.
Facilities
DDR shall ensure that the Tenants are introduced to the Services provided with the Property and that they are instructed in the use of the electrical appliances.
Insurance
DDR shall ensure that the Property is insured at all times to include Public Liability Insurance in the case of Accidental damage to Property or person.
Alternative property
DDR shall use it’s best endeavours to ensure that the Tenants do occupy the Property for which they booked but in the event of either Force Majeure or any other such emergency, DDR shall use its best endeavours to provide the Tenants with an alternative Property of equal or superior quality.
Responsibilities
DDR will use all reasonable skill and care in performing and providing it’s service to the Tenants but shall not be responsible for any injury, illness, death, loss, damage or claim of whatsoever nature which may result from either of the following:
a. fault of the person(s) affected or any member(s) of their party.
b. fault of a third party not connected with the provision of the accommodations by DDR whish DDR could not have predicted or avoided.
c. An event or circumstance whish could not have been predicted or avoided even after taking all reasonable care and skill.
DDR shall not be responsible for any services that do not form part of this Agreement i.e. any other services supplied by outside Contractors.
Changes
DDR will use it’s best endeavours to provide such changes to their Booking as are required by the Tenants, providing the Tenants do give at least 7 days notice of such changes required.
Rates
DDR has the right to increase or decrease the Letting Rates prior to Booking. Once the booking has been made and the Deposit paid, DDR shall not increase the rates unless it be by virtue of some event beyond the control of DDR, in which case DDR shall give Notice to the Tenants as soon as practicable so to do.
Security Deposit
DDR shall return all Security Deposits to the Tenants at the end of the Holiday Let, providing no damage has been caused to the Property, other than normal wear and tear. In the event that damage has been caused to the Property, DDR shall be entitled to retain that portion appropriate to rectify and such damage caused and in the event that the deposit is insufficient to cover the cost of rectification for such damage caused, DDR has the right to claim and sue the Tenants for any further loss incurred.
Cancellations
DDR does reserve it’s right to cancel any booking from time to time and whilst DDR shall always try to avoid any change or cancellation, in the event of circumstances beyond it’s control, DDR must so reserve this right.
Possessions
DDR shall not be responsible for any loss and/or damage to any luggage or personal possessions (including money).
Complaints
In the unlikely event that a complaint should be made by the Tenant during the Holiday Let DDR will act as soon as practicably possible to rectify any such complaint, providing it is within the Power and Authority of DDR to so rectify. In the event that any complaint shall be made by the Tenants, such complaints must be in writing and sent to DDR as soon as possible.
Website
DDR does not accept responsibility for the accuracy shown on it’s Website(s) although every effort is made to ensure the accuracy of the Properties available and the Rates from time to time.
Additional requests
DDR will endeavour to meet all reasonable additional requests made by the Tenants under the provision in the Booking Form but DDR cannot Guarantee that those requests will be met. In the event that a special request is not met by DDR, such failure on the part of DDR shall net be construed as a Breach of this Agreement.
Medical problems
DDR cannot accept responsibility for the failure of the Booking in the event of any Medical Problems or disabilities on the part of the Tenants, unless such Problem or Disability is known to DDR at the time of Booking, in which case DDR can consider suitability of the Property required. DDR does reserve the right to decline any booking that it does not feel capable of being able to fulfill appropriately.
Tenants Obligations
Arrival
The Tenant shall ensure that they arrive at the Property at the allocated time, unless prior notice has been given to DDR of any delay.
Tenant
Only those persons appearing on the Booking Form shall occupy the Property and the number of persons must not exceed the number of sleeping places indicated on the Booking Form or Website(s). There shall be no substitution of any persons during the Holiday Let, unless previously agreed.
Identification
Upon arrival, you must present your Passports to DDR or it’s representative along with your booking form. The Passports will be required for identification purposes only and will be handed back to the Tenants immediately. DDR is obliged, however, to retain a copy of the passport.
Payments
The first 20% of the Balance of your Holiday Let will be charged directly by DDR during the online booking, the other 80% will be charged 30 days before Arrival. A refundable security deposit will be blocked (not charged) on your credit card. The amount of the security deposit will be detailed on the booking form. You are obliged to report to us or our agents or any loss, damage or breakages that may happen. In default, DDR has the right to treat this Agreement as cancelled.
Changes
In the event of any change to the Holiday Let the Tenant must notify DDR as soon as possible.
Cancellation
In the event of Cancellation, the Tenants must notify DDR immediately and any notice will only be effective upon receipt by DDR. Depending on the notice, the following cancellation charges shall apply:
- more than 12 weeks: no charges
- less than 12 weeks: 10% balance
- less then 8 weeks: 20% balance
- less than 4 weeks: 50% balance
- less then 2 weeks: full balance
Insurance
The Tenants must ensure that they obtain the appropriate level of Travel and Sickness Insurance and that they have purchased a return flight ticket or have sufficient means to depart from Dubai of their own accord.
Visa
The Tenants must ensure that they have obtained the appropriate Visit Visa to Dubai and that such Visa covers the period of the Holiday Let. In the event that the Tenants do not arrive at the accommodations for reasons related to Visa issues, DDR will not be liable to refund any monies of whatsoever nature to the Tenants.
House rules
The Tenants must not make excessive noise of nuisance to neighboring Properties and must not cause damage to the Property or any neighboring Property. In the event that any such excessive noise or nuisance or damage is so caused, DDR shall have the right to Terminate this Agreement and the Tenants shall be required to immediately vacate the Property whereupon the Tenant(s) shall not be entitled to any refunds and DDR shall have no further responsibility towards the Tenant(s). In the event of excessive damage to the Property, the Tenants will be fully responsible for the reasonable losses incurred.
Departure
The Tenants must leave the Property in the same condition as at the start of the Holiday Let. In the event of any accidental damage, the Tenants must inform DDR as soon as practicably possible, otherwise it will be assumed that the Tenant has caused such damage.
Failure or breakdown
The Tenants must notify DDR in the event of failure or breakdown of any of the services or equipment provided to ensure that DDR can remedy such failure or breakdown expediently.
End of holiday let
The Tenants shall be required to vacate the Property at the end of the Holiday Let. In the event the Tenants do not so vacate, DDR has the right to charge such penalties as are necessary to cover all loss and damage caused, which shall include any loss of income to DDR from Holiday Let otherwise booked.
